Agreement Overview
Your legal agreement with NexifyHosting

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "you") and NexifyHosting ("we", "us", or "our") regarding your use of our hosting services, including but not limited to Minecraft server hosting, VPS hosting, and Discord bot hosting.

By creating an account, purchasing services, or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

Important: These Terms may be updated from time to time. Continued use of our services after changes constitutes acceptance of the new Terms.

Account Registration & Security
Requirements and responsibilities for your account

Registration Requirements:

  • • You must be at least 18 years old or have parental consent
  • • Provide accurate, current, and complete information
  • • Use a valid email address for account verification
  • • Choose a secure password and keep it confidential
  • • One account per person or organization

Account Security:

  • • You are responsible for all activities under your account
  • • Notify us immediately of any unauthorized access
  • • Do not share your login credentials with others
  • • Enable two-factor authentication when available
  • • Keep your contact information up to date

Account Suspension

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to our infrastructure.

Service Usage & Limitations
How you may use our hosting services

Permitted Uses:

  • • Hosting Minecraft servers for gaming communities
  • • Running Discord bots for server management
  • • VPS hosting for legitimate business purposes
  • • Educational and development projects
  • • Personal websites and applications

Resource Limits:

  • • CPU, RAM, and disk usage as specified in your plan
  • • Bandwidth limits apply to all plans
  • • Fair usage policy for "unlimited" features
  • • No cryptocurrency mining or similar intensive processes
  • • Maximum file size and upload limits

Technical Support:

  • • 24/7 support for server-related issues
  • • Limited support for third-party software
  • • No support for custom modifications or plugins
  • • Response times vary by plan level
Acceptable Use Policy
Prohibited activities and content restrictions

Strictly Prohibited:

  • • Illegal activities or content under EU or international law
  • • Harassment, hate speech, or discriminatory content
  • • Spam, phishing, or fraudulent activities
  • • Malware, viruses, or malicious software
  • • Copyright infringement or pirated content
  • • Adult content or pornographic material
  • • Gambling or betting services
  • • Drug-related content or illegal substances

Network Abuse:

  • • DDoS attacks or network flooding
  • • Port scanning or vulnerability testing
  • • Proxy or VPN services (without permission)
  • • Excessive bandwidth consumption
  • • IRC bots or file sharing networks

Enforcement:

Violations may result in immediate service suspension, account termination, and forfeiture of all fees paid. We cooperate with law enforcement agencies when required by law.

Payment Terms & Billing
Pricing, billing cycles, and payment policies

Pricing & Currency:

  • • All prices are listed in Euros (EUR) including applicable taxes
  • • Prices may change with 30 days advance notice
  • • Existing customers maintain their pricing for current billing cycle
  • • Setup fees may apply to certain services

Billing Cycles:

  • • Monthly billing: Charged every 30 days
  • • Annual billing: Charged every 365 days with discount
  • • VPS services: Hourly billing with monthly caps
  • • Automatic renewal unless cancelled

Payment Methods:

  • • Credit/Debit cards (Visa, Mastercard, American Express)
  • • PayPal and other digital wallets
  • • Bank transfers for enterprise customers
  • • Cryptocurrency (Bitcoin, Ethereum) where available

Late Payments:

Services may be suspended after 7 days of non-payment. Accounts are terminated after 30 days, and all data is permanently deleted. A €10 late fee may apply to overdue accounts.

Service Availability & SLA
Uptime guarantees and maintenance policies

Uptime Guarantee:

  • • 99.9% uptime guarantee for all hosting services
  • • Excludes scheduled maintenance windows
  • • Service credits for extended downtime
  • • Real-time status monitoring available

Maintenance:

  • • Scheduled maintenance with 48-hour notice
  • • Emergency maintenance may occur without notice
  • • Maintenance windows: 02:00-06:00 CET
  • • Updates posted on status page

Data Backup:

  • • Daily automated backups for all services
  • • 7-day backup retention period
  • • Customer responsible for additional backups
  • • Backup restoration may incur fees
Privacy & Data Protection
How we handle your personal and service data

Data Collection:

  • • Account information (name, email, billing details)
  • • Service usage data and logs
  • • Technical information for support purposes
  • • Communication records with support team

Data Usage:

  • • Service provision and account management
  • • Technical support and troubleshooting
  • • Billing and payment processing
  • • Security monitoring and fraud prevention

Your Rights:

  • • Access your personal data
  • • Request data correction or deletion
  • • Data portability upon request
  • • Opt-out of marketing communications

Liability & Disclaimers
Legal limitations and disclaimers

Service Disclaimer:

Our services are provided "as is" without warranties of any kind. While we strive for high availability and performance, we cannot guarantee uninterrupted service or complete data security.

Limitation of Liability:

  • • Our liability is limited to the amount paid for services
  • • We are not liable for indirect or consequential damages
  • • Customer responsible for data backup and security
  • • Force majeure events exclude liability

Indemnification:

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or infringement of third-party rights.

Service Termination
How services can be terminated by either party

Customer Termination:

  • • Cancel services anytime through your account panel
  • • 30-day notice required for annual plans
  • • No refunds for partial months (except as per Refund Policy)
  • • Data deleted 7 days after termination

Our Termination Rights:

  • • Immediate termination for Terms violations
  • • Non-payment after grace period
  • • Abuse of resources or network
  • • Legal requirements or court orders

Data Recovery: After termination, data may be recoverable for up to 7 days for a recovery fee. After this period, all data is permanently deleted and cannot be recovered.

Legal Information
Governing law and dispute resolution

Governing Law:

These Terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of Amsterdam, Netherlands.

Dispute Resolution:

We encourage resolving disputes through direct communication. If this fails, disputes may be resolved through mediation or arbitration before court proceedings.

Severability:

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
